Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Clovelle mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via the App or email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use Clovelle. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You may register using your email address or via Google sign-in. You must immediately notify us of any unauthorized use of your account at support@closetly.app.

4. User Content

You retain ownership of all content you upload to Clovelle, including photographs of clothing items, outfit arrangements, and metadata (“User Content”). By uploading User Content, you grant Clovelle a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service to you.

You represent that you own or have the necessary rights to all User Content you upload and that your User Content does not infringe upon the intellectual property or privacy rights of any third party.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Attempt to gain unauthorized access to the App, other user accounts, or our servers.
  • Interfere with or disrupt the integrity or performance of the App.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Use automated means (bots, scrapers) to access or collect data from the App.
  • Resell, sublicense, or commercially exploit the App without our express written consent.

6. Subscriptions and Payments

Clovelle offers free and paid subscription tiers (Plus and Pro). Subscription fees are billed through the Google Play Store and processed by RevenueCat. All payments are subject to Google Play's terms and conditions.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Google Play account settings.

Refund requests are handled according to Google Play's refund policies. We may offer promotional trials or discounts at our discretion. We reserve the right to change subscription pricing with prior notice.

7. AI-Powered Features

Clovelle includes AI-powered features for item tagging, outfit suggestions, and style insights. These features are provided on an “as is” basis. While we strive for accuracy, AI-generated suggestions and tags may not always be correct.

You acknowledge that AI features are tools to assist your styling decisions, not guarantees of outcomes. You remain responsible for your fashion choices. AI personalization can be disabled in Settings at any time.

8. Intellectual Property

The Clovelle name, logo, app design, user interface, software code, and all related materials are the exclusive property of Clovelle and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our written permission.

9. Third-Party Services

The App may integrate with third-party services including Appwrite (backend), RevenueCat (subscriptions), and Google (authentication). We are not responsible for the availability, accuracy, or practices of these third-party services. Use of such services is subject to their respective terms and policies.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOVELLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Clovelle, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

13. Termination

You may terminate your account at any time by contacting support@closetly.app or using the account deletion option in your Profile settings. Upon termination, your User Content and personal data will be deleted in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Clovelle operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
